ORDINANCE 2012-3

 

AMENDING THE TOWNSHIP LAND DEVELOPMENT ORDINANCE AT

SECTION 1000 GOVERNING “ADMINISTRATION, WAIVERS,

ENFORCEMENT, VIOLATIONS AND PENALTIES”

 

            WHEREAS, by Ordinance 2009-4, the Township previously amended the provisions governing of the Land Development Ordinance at Section 1000 governing “Administration, Waivers, Enforcement, Violations and Penalties”; and

            WHEREAS, those revisions included a requirement with respect to Zoning Permits that certain conditions be met prior to issuance; and

            WHEREAS, pursuant to N.J.S.A. 40:55D-65(h), the Township Council of the Township of Medford desires to add the condition that no taxes or assessments for local improvements are due or delinquent on the property for which any application is made.

            NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Medford, County of Burlington, State of New Jersey that the Land Development Ordinance of the Township of Medford be amended as follows:

            SECTION ONE. 

            Section 1000, “Zoning Permit” is hereby amended to add the following subsection:

            J.  Issuance of a Zoning Permit.

5.         No Zoning Permit shall be issued unless the applicant has obtained and submitted a certification from the Tax Collector that no taxes or assessments are due or delinquent on the property for which any application is made.

            SECTION TWO:  All Ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of such inconsistency.

            SECTION THREE:  If any section, paragraph, subdivision, clause or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision and the remainder of this ordinance shall be deemed valid and effective.

            SECTION FOUR:  This ordinance shall take effect immediately upon final passage and publication according to law.

 

 
                       

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

                       

The above entitled ordinance was passed on first reading at a meeting of the Township Council of the Township of Medford on _________, 2012.  It will be further considered for final passage after a public hearing at the regularly scheduled meeting to be held on ____________, 2012 at the Public Safety Building, 91 Union Street, Medford, New Jersey at 7:30 PM, at which time and place any persons desiring to be heard upon the same will be given the opportunity to be heard. Copies of this ordinance will be made available at the Municipal Clerk’s office to members of the general public who shall request them.
