RESOLUTION 84-2010

 

                 AUTHORIZING AMENDMENT #2 TO

COMMUNICATIONS SITE LEASE AGREEMENT

 

          WHEREAS, the Township of Medford entered into a Site Lease Agreement on September 27, 1997 with Nextel Communications of the Mid-Atlantic, Inc., and same Agreement was revised on February 9, 1998 via Addendum #1; and

          WHEREAS, the carrier recently received land use approval to exchange certain existing equipment with new equipment and to add a parabolic dish, and a condition of that approval included an increase in rent; and

          WHEREAS, the parties agree that an additional $200 per month rent is required to compensate the municipality for this expansion of use.

          NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Medford that the Township shall and is hereby authorized to enter into  Amendment #2 to the Communications Site Lease Agreement with Nextel Communications of the Mid-Atlantic, Inc. to increase the rent an additional $200 per month.

          BE IT FURTHER RESOLVED that the terms and conditions of this Amendment are set forth in the Amendment #2, attached hereto and made a part hereof

          BE IT FURTHER RESOLVED that the Township Manager and Township Clerk shall be and are hereby authorized to execute said agreement.

 

 

            I hereby certify that the foregoing is a true copy of a Resolution adopted by the Township Council of the Township of Medford, at a meeting held on the 9th  day of March, 2010.
