RESOLUTION 82-2010

AUTHORIZING EXECUTION OF A

SHARED SERVICES AGREEMENT WITH

MEDFORD TOWNSHIP BOARD OF EDUCATION

WHEREAS, the Township Council of the Township of Medford wishes to enter into a Shared Services Agreement with the Medford Township Board of Education (“BOE”) for the shared use of athletic fields owned by the BOE, located on the site of Chairville School, 36 Chairville Road in Medford Township; and

WHEREAS, by entering into the Agreement the Township and the BOE agree that the shared use of the aforementioned athletic fields benefits each public entity equally; and

WHEREAS, in recognition of the Township’s financial contribution to the improvements of these fields, the BOE will not charge a facility/equipment usage fee to the Township; however, the Township will be charged for custodial time and any damages incurred to the athletic fields and/or equipment as described in the attached Facility Usage Policy/Regulations; and

WHEREAS, all contractual provisions have been negotiated and an agreement has been entered into between the Township and the BOE, which agreement is attached hereto and made a part hereof; and

WHEREAS, the BOE approved the execution of the Shared Services Agreement with the Township of Medford at its February 8^th, 2010 meeting; and

WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1 et seq., authorizes and empowers the Township and BOE to enter into this agreement.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Medford that the Mayor and Township Clerk be and are hereby authorized to execute this Shared Service Agreement with the Medford Township Board of Education.

I hereby certify that the foregoing is a true copy of a Resolution adopted by the Township Council of the Township of Medford, at a meeting held on the 9^th day of March, 2010.
