COUNCIL MEETING

July 3, 2010

  

The Medford Township Council Meeting of the above date was convened by

Mayor Martin, followed by the salute to the flag and reading of the Open Public Meetings Act Statement.

            MANAGER’S REPORT

 

Mr. Addezio announced that Stacy McBride, Deputy Court Administrator,

received designation as a Court Administrator.

 

Mr. Addezio presented the bill list for payment.

 

Mr. Addezio had previously entertained and answered questions with regard to the payment of the bills.  There being no further questions, the bill list was approved for payment as presented.

 

Mr. Brown approved the bill list, seconded by Deputy Mayor Myers.

 

Deputy Mayor Myers asked for a report on what state agencies were involved

with the Hartford/Route 70 Project.  The Deputy Mayor will write a letter to the

Governor once he received the names of the agencies.

 

Deputy Mayor Myers asked the Manager to have the engineer report on the

solar projects at the next Council meeting.  He would also like the engineer to see if the RFP can include fixing the roof of the PAB to sustain solar panels.

 

ENGINEER’S REPORT

 

The engineer was not present at this meeting, so no report was given. 

 

 

SOLICITOR’S REPORT

 

            Mr. Hunt discussed a resident James Pace coming to the May 25, 2010 Council

            Meeting and giving him an email chain from October 2007 to November 2007. 

            Mr. Pace claimed that these emails represented misuse of public property by     

            Councilman Brown because there was reference to a republican rally and a road  

            inspection. Mr. Hunt went through the emails in chronological order and found

no linkage between the two subjects. In conclusion, Mr. Hunt did not feel that

there had been any violations of the Township ethics code. 

 

Mr. Hunt explained that the nature of the business and not the email address is

what constitutes township business.   

           

            PUBLIC

 

            Randy Pace, 46 Woodthrush Trail, stated he was in receipt of Mr. Hunt’s letter. 

            He stated the letter did not address original request asking if the township policy prohibits campaign contributions from employees.  Mr. Pace also made statements about the email address that Mr. Brown was using as his official email.

 

Mr. Hunt said the letter did address the original request and responded about the website address, that the Clerk has initiated Township email addresses.  Mr. Hunt then commented that the issue is not the email address but the content of the email.

 

            Mr. Pace stated that Mr. Luers, only represents him in the OPRA check register       

            issue and not in any other issues.

 

            Deputy Mayor Myers commented that Mr. Pace asked us to look into the matter

            and they did.

 

            Mr. Pace respectfully disagrees with Mr. Hunt’s opinion in the letter.

 

            Mr. Pace brought up Tamarac Association matters and was told by Mr. Hunt and        

            Mayor Martin this could not be discussed.

 

            Ted Nash, 19 Shadow Oak Drive,  Mr. Nash stated that he has known

            Councilman Brown for over twenty two years and has found him to be ethical. 

            They have worked on several projects together and thanked him for his service

            to the town.

 

            Chris Buoni, 20 Woodthrush Trail, made comments about the email address used

            by Councilman Brown.

 

Deputy Mayor Myers asked Mr. Hunt for a ruling on the public being able to speak a length of time.

 

            Mr. Hunt stated that Council is not here to give legal advice to questions posed by         the public during public session.

 

            Mr. Hunt also state that according to a newspaper article, Mr. Pace went to the

            DCA (Department of Community Affairs) with the ethics complaint.

 

            Mr. Buoni brought up Lisa Post and asked if she was a paid employee. 

 

            Mr. Addezio responded that Ms. Post is not a paid employee.

 

            Mr. Buoni then stated that the resolution on the sewer rate increase was not the

            resolution that was presented to the public. 

 

            Mr. Hunt explained that the resolution was changed the week of the meeting and           

            inadvertently was not changed in the public’s packet.  

 

            Marlene Lieber, 2 LaRue Lane, questioned the reason for Saturday morning

            meetings. Feels that a ethics course is needed and that an email that mentions

            political contributions is unethical. 

 

            Richard Smith, 5 Elm Court,   Criticized the sewer increase and will be here

            to continue to criticize things.  He also stated that he has covered several meetings

            in several towns and found two of the speakers to be appalling.

 

            Walt Williams, 1 Foxwood Lane, stated he has known Councilman Brown for

            twenty five years and Councilman Brown has volunteered and dedicated his time  

            to Medford.  He then stated that Mr. Rosen did not do his homework and that Mr.

            Pace attacks public positions.

 

            Dan Kramer, Tamarac Resident, stated this was his first Council meeting and

            found it very interesting.  Councilman Brown is an amazing guy and is appalled at

            some of the things that have been said today. 

 

            Laura Saunders, 170 Taunton Boulevard, in reading the papers she saw cuts with

            the budget and asked were the cuts were made.

 

            Deputy Mayor Myers explained the solar savings.  The elimination of fireworks

            and phone savings by switching carriers. 

 

            Ms. Saunders asked what the solar project is costing the tax payer. 

 

            Deputy Mayor Myers responded zero dollars because it is done thru a Power

            Purchase Agreement (PPA).

 

            Ms. Saunders then asked what the permitting capacity for the plant is.

 

            Mr. Addezio will get the answer on permitting capacity.

 

ORDINANCES FOR INTRODUCTION

 

ORDINANCE 2010-23 “CALENDAR YEAR 2010 MODEL ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40a:4-45.14)

 

            Mr. Brown for approval of the ordinance, advertisement and set date of July 31, 2010 for public hearing, seconded by Mr. Lynn.

                       

            Roll call vote for approval as follows: Mr. Brown, aye, Mrs. Fay, aye, Mr. Lynn, aye, and Mayor Martin, aye. Deputy Mayor Myers voted nay.

 

ORDINANCE 2010-24 “ACCEPTING DONATION OF BLOCK 709, LOT 3”

 

            Mr. Lynn for approval of the ordinance, advertisement and set date of July 31, 2010 for public hearing, seconded by Mr. Brown.

 

Deputy Mayor Myers asked why this is done by ordinance.

 

Mr. Hunt replied that property can only be accepted via an ordinance.

 

            Roll call vote for approval as follows: Mr. Brown, aye, Mrs. Fay, aye, Mr. Lynn, aye, Deputy Mayor Myers, aye and Mayor Martin, aye.

 

ORDINANCE 2010-25 “ORDINANCE AMENDING SECTION 613 OF THE CODIFIED MEDFORD TOWNSHIP LAND DEVELOPMENT ORDINANCE ENTITLED “AFFORDABLE HOUSING ORDINANCE PROVISIONS”

 

            Mrs. Fay for approval of the ordinance, advertisement and set date of July 31, 2010 for public hearing, seconded by Mr. Brown.

 

Deputy Mayor Myers asked why we are doing this ordinance.

 

Mr. Hunt explained that this is for a third party administrator to assist in marketing COAH units.

 

            Roll call vote for approval as follows: Mr. Brown, aye, Mrs. Fay, aye, Mr. Lynn, aye, Deputy Mayor Myers, aye and Mayor Martin, aye.

RESOLUTIONS

 

Resolution 149-2010 “RESOLUTION TO DEFERRED 2009 LOCAL SCHOOL AND REGIONAL HIGH SCHOOL TAXES”

           

Deputy Mayor Myers moved for approval of the resolution, seconded by Mr. Brown.

 

Mayor Martin opened the meeting for public comments.

 

There were no public comments.

 

The motion for approval was duly made, seconded and affirmatively voted upon by all Council present.

 

Resolution 150-2010 “a resolution to read the medford township 2010 year municipal budget by title only in accordance with N.J.S.A. 40A:4-8”

 

Mr. Brown moved for approval of the resolution, seconded by Mr. Lynn.

 

Mayor Martin opened the meeting for public comments.

 

There were no public comments.

                       

The motion for approval was duly made, seconded and affirmatively voted upon by all Council present.

           

Resolution 151-2010 “2010 Municipal Budget”

 

Mr. Brown moved for approval of the resolution allowing for a three cent tax increase, seconded by Mr. Lynn. 

 

Mayor Martin opened the meeting for public comments.

 

Marlene Lieber, 2 LaRue Lane, will the public have a chance to review budget.

        

The motion for approval was duly made, seconded and voted upon by all Council present.  Mr. Brown, Mr. Lynn and Mayor Myers voted aye.  Deputy Mayor Myers and Mrs. Fay voted naye.

 

 

Resolution 158-2010 “RESOLUTION FOR RENEWAL OF MEMBERSHIP IN THE BURLINGTON COUNTY MUNICIPAL JOINT INSURANCE FUND”

 

Deputy Mayor Myers moved for approval of the resolution, seconded by Mr. Brown.

 

Mayor Martin opened the meeting for public comments.

 

There were no public comments.

                       

The motion for approval was duly made, seconded and affirmatively voted upon by all Council present.

 

Resolution 159-2010 “APPROVING REQUEST FOR FINAL RELEASE OF PERFORMANCE GUARANTEE WILDERNESS LAKES & CLUBHOUSE

Mr. Lynn moved for approval of the resolution, seconded by Deputy Mayor Myers.

 

Mayor Martin opened the meeting for public comments.

Resolution 160-2010 “approving request for performance guarantee reduction no. 1 scott c. jarvis (route 541 retail property) spr-5627/pbc-496”

 

Deputy Mayor Myers moved for approval of the resolution, seconded by Mr. Brown.

 

         Mayor Martin opened the meeting for public comments.

        

The motion for approval was duly made, seconded and affirmatively voted upon by all Council present.

 

Resolution 161-2010 “RESOLUTION OF THE TOWNSHIP OF MEDFORD, COUNTY OF BURLINGTON MAKING APPLICATION TO THE LOCAL FINANCE BOARD PURSUANT TO n.j.s.a:4-45.46”

 

Mr. Lynn moved for approval of the resolution, seconded by Mr. Brown.

 

Mayor Martin opened the meeting for public comments.

 

There where no public comments.

 

The motion for approval was duly made, seconded and affirmatively voted upon by all Council present, except Deputy Mayor Myers voted nay.

PUBLIC

 

Christine Balentine, 2 LaRue Lane, commented that she listened to ethics complaints about Mr. Lynn and Mr. Brown.  She judges Mayor Martin for voting on the school budget.  She doesn’t feel that in twenty five years of legal service that advice is good.  Mrs. Balentine stated that before you raise my taxes, how about you look at our

solicitor ship.

There being no further business, Mr. Brown moved that the meeting be adjourned at 12:12 PM seconded by Deputy Mayor Myers with all members in agreement.
