INSTRUCTION SHEET FOR AFFIDAVIT OF COMPLIANCE
(Required for all Development Applications which include land and/or building construction)
As part of a development approval, you are required to submit an Affidavit of Compliance. The document is used to support closure of your approval resolution so that you can proceed to the next level of your development approval.
In order to prepare a comprehensive Affidavit, you will use a copy of the executed approval resolution as an outline. This document stipulates the conditions of approval that must be met in order to obtain a construction permit, building permit, and/or execution of any maps and/or deed by municipal officials. (NOTE: Refer to the area in your resolution that generally begins with NOW THEREFORE BE IT RESOLVED: immediately following this section will be a list of conditions by number imposed as part of the Board’s approval). Also, any conditions as listed in the planner’s or engineer’s letters as referenced in the resolution must be completed.
Using the number of each condition within the resolution, you are responding to that condition by attaching that document that indicates you have satisfied the condition imposed. For example: if a Developer’s Agreement was required as part of the approval, you would attach to the Affidavit a copy of the executed developer’s agreement. County Soil Conservation District is usually involved in a site plan application, using this example, you would attach a copy of the County Soil’s certification document indicating that they have approved this plan. The same goes for each and every agency, department and other official review agencies that were involved in this development approval process. Each of the conditions imposed must have a document that supports all plans and/or work has been done in accordance with the department’s requirements and/or the Board’s professionals. When your affidavit is complete, it must be notarized prior to submission.
In addition, the Construction Office must be satisfied that plans from proposed construction permits are adequate for “pre-con” stage of this process. Be advised that the Affidavit of Compliance and required documents must be submitted prior to scheduling of a pre-construction meeting. Please find attached a copy of the pre-construction checklist used at the meeting.
